Agreed, it would have been very bad for Hyperion if this motion would have been granted, but the current situation doesn't look very bright either. The case will take years now, and I somewhat doubt Hyperion has the cash for it (while A Inc appears to have piles of money to spend).

I can't imagine any long term A-Inc investors being very interested in a long term bun fight. Quite hard to get a good return on their investment :-?

looks like amiga inc claim is beeing questioned quite seriously... they own nothing other than DE. I'll bet the new money will dry up quickly with law suits like this goign on.
wonder if they can still make that payment to the city of kent in time?

A very interesting read. All very legal but it was clear that Amiga Inc; no Bill McEwen has lied continually to remain in business and that the court saw through the ridiculous amount of lies/irregularities presented by Amiga Inc.

One thing I have not quite understood is if KMOS/Amiga do not own the rights to Amiga OS (as it appears) then who does?

Obviously Hyperion and Eyetech are in the frame here due to Amiga Washington's insolvency but I am still unsure.

Can't be arsed waiting to find out truth be told. Unless Amiga Inc gives up (which it won't) then whats the point - another 2-4 years of waiting. Not for me thank you.

PPC & Ubuntu for me - Wheeeeee!!!!

I wish they would all just get together with a mediator (not the PCI bridge kind) and work out an acceptable solution for everyone.

The only persons benefiting from all this now are the fraking lawyers.

Aren't they smart enough to figure out a "Win-Win" solution?

The real crime has been the hoodwinking of the community by the dishonesty of those in both companies, who have done nothing but lie and connive for more than half a decade now.

In the end it doesn't really matter as they're fighting over who owns a carcass.

(I should add that people here are reading too much into this decision. This is not in any way a win for either side. It's just that the court found no justification or need for an injuction. The court clearly states that some crucial issues over dates and allocation of payments are unclear and in dispute, and at no point do they support Hyperion's position as defendant.)

Getting my two cents in everywhere,

I am sorry but I do not see where Ainc has lost anything except the right to injunct Hyperion from selling OS4 to an Amigaone computer builder. The judge stated that the status quo remained. He could not see on the basis of Ainc's argument where they would be finacially harmed by leaving things the way they were and that the points which Ainc has brought to the injuction hearing are obvioulsy in dispute and that only a court case would be able to decide them. The court case will hinge on weather Hyperion can prove that Ainc Washington was insolvent and therefore must turn over the properties to Hyperion and Eyetech. And the judge stated that he did not see where that was proved in Hyperions response to the request for an injuction. The only thing I think is that this will take a lot longer and that is too bad for us.

The situation is: Ainc must win to get os4 into their hands.
Hyperion must not to lose, to continue his work.
Recently ainc not win, hyperion not lose, so now hyperion seems the winner.
